Welcome to Nabire Whale Shark. By accessing our website or booking a tour with us, you agree to be bound by these Terms of Service. Please read them carefully before proceeding with any booking.
1. Tour Bookings and Confirmation
A booking is confirmed only upon receipt of the required deposit and written confirmation from Nabire Whale Shark. All bookings are subject to availability. We reserve the right to decline any booking request at our discretion. The booking confirmation email constitutes the contract between you and Nabire Whale Shark.
It is your responsibility to ensure that all booking details, including guest names, dates, tour selection, and contact information, are accurate. Any errors must be reported to us immediately. Additional charges may apply for amendments made after confirmation.
2. Payments
A non-refundable deposit of 30% is required to confirm your booking. The remaining balance is due 14 days before the tour date. For bookings made within 14 days of departure, full payment is required at the time of booking. All prices are quoted in Indonesian Rupiah (IDR). Foreign currency equivalents are indicative only and subject to exchange rate fluctuations.
3. Cancellation Policy
Cancellations must be submitted in writing to [email protected]. Cancellations made 30 or more days before departure are eligible for a refund of the balance paid (deposit is non-refundable). Cancellations made 15–29 days before departure forfeit the deposit only. Cancellations made within 14 days of departure are non-refundable in full. We strongly recommend purchasing comprehensive travel insurance.
Nabire Whale Shark reserves the right to cancel tours due to severe weather, unsafe sea conditions, government travel advisories, force majeure events, or circumstances beyond our control. In such cases, we will offer a full refund or alternative dates. We are not liable for any additional costs incurred, including flights or accommodation.
4. Health and Safety Requirements
Guests must be in good physical health to participate in water activities. You are responsible for disclosing any medical conditions, disabilities, or health issues that may affect your ability to participate safely. Guests with heart conditions, epilepsy, severe asthma, or recent surgery may not be permitted to participate. We reserve the right to exclude any guest from an activity on safety grounds.
All guests must follow the safety briefing and instructions of our guides at all times. This includes maintaining appropriate distance from whale sharks, not touching marine life, and following snorkelling/diving protocols. Non-compliance may result in immediate removal from the water without refund.
5. Environmental and Conservation Rules
Cenderawasih Bay is a national marine park under Indonesian law. All guests must adhere to park regulations, including: no touching or riding whale sharks, no flash photography, maintaining minimum approach distances, no littering, no collection of marine specimens. Violations may result in fines under Indonesian environmental law.
6. Liability
Nabire Whale Shark is not liable for personal injury, loss, damage, or expenses arising from circumstances beyond our control, including weather, natural disasters, government actions, or the actions of third parties. Our liability is limited to the direct costs paid for the affected tour. We strongly recommend that all guests obtain comprehensive travel insurance covering water activities and medical evacuation.
7. Photography and Media
By participating in a Nabire Whale Shark tour, you consent to being photographed or filmed for promotional purposes. You grant us a non-exclusive, royalty-free licence to use such images or footage on our website, social media, and marketing materials. If you do not consent, please notify us in writing before the tour.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Papua Province, Indonesia.
